Wheelchair-bound Tom Mundy has been unemployed for the past two years. Yet he's still making six figures by what some call "legal extortion". Mundy, who lives in California, notes every time a restaurant or business in the state doesn't have wheelchair-friendly tables, bathrooms or other features required by the Americans with Disabilities Act, he documents these violations -- however small -- and sues. Usually, the businesses pay Mundy a settlement of a few thousand dollars to avoid trial. A lawyer says the establishments should get a chance to fix the violations before having to pay, and calls Mundy's actions "legal extortion in the guise of helping." But Mundy says his critics should go out with him in his wheelchair to see how hard it is for him to get around. |

The Americans with Disabilities Act (ADA) is a
Federal civil rights law that prohibits the exclusion of people with
disabilities from enjoying everyday activities. It offers protection for the
sight-impaired, hearing-impaired, and wheelchair bound to name a few.
Every business, corporation and public entity is required to
comply with the American Disabilities Act (ADA). The ADA establishes
requirements for 12 categories of public accommodations, including stores and
shops, restaurants and bars, service establishments, theaters, hotels,
recreation facilities, museums and schools and others. Nearly all types of
businesses that serve the public are included in the categories, regardless of
size. Compliance begin with an accessibility survey report. The accessibility
survey report draws attention to deficiencies or items that are not within
compliant regulations. Items or elements that do not meet minimum specifications
for requirements of compliance are recorded, and noted into a report. This is
often referred to as a barrier removal or transition plan.
